Sub: Willful violation of HSPF Rules 1966

Dear Sir,

Before it is too late for SAIL-RDCIS Management to take remedial action for avoiding withdrawal of Govt. permission for maintaining separate HSPF Trust we would like to bring to your kind notice the following disturbing facts for your information and early remedial action.

I. The Chairman and the Secretary of the HSPF Trust are willfully violating the provisions contained in Rule 24 of the HSPF Rules 1966. Rule 24 provides for distribution of the entire amount of interest earned by the Trust to all its eligible members. In spite of our written and verbal persuasions around one crore rupees out of total interest earned by the Trust during the year 1996-97 to 2000-01 is still kept undistributed to P.F. members.

II. The two office bearers also misguided the B.O.T. in the Trust meeting on 10th Jan 2003 and got wrong decision taken with respect to Ex-Employees by paying only those who were on the roll of SAIL on both 1st April 2002 and 10th Jan 2003.

III. Similarly a portion of interest out of total interest earned by the Trust during the year 2002-03 has also been arbitrarily distributed to some P.F.members only. Some eligible members have been denied their share. Our oral and written requests in this regard have fallen on deaf years. This is in clear violation of Rule 24 and non-fulfillment of functions and responsibilities prescribed for Trustees in Rule 17.

IV. Ruling of the CPFC in Para 2 of his letter dated 21st Nov 2003 enclosed with the letter of RPFC Ranchi dated 8th Dec.2003 addressed to the then ED & I/c RDCIS clearly stated that the decision in Para II above was clear violations of HSPF Trust Rules. This has also been carried while implementing the decisions in matter related to Para III above. The content in Para 2 of CPFC’s letter Quote”As per Rule 24 of the HSPF Trust Rules the entire surplus earned by the Trust in a year is to be distributed among the members of the Trust on pro-rata basis in the same year which implies that surplus available with the Trust is to be distributed among all members of the Trust existing between 96-97 to the date of declaration of surplus interest”.

V. Even after the clear Ruling by the CPFC in above Para the two office bearers have failed to distribute around Rs. one crore mentioned in Para I above for two years which is, by all accounts, illegal and a criminal act.

VI. If these violations go to the knowledge of the Govt. officials there is danger of getting Govt. permission to maintain separate HSPF Trust withdrawn creating enormous practical difficulties to all P.F.members of SAIL Units at Ranchi which we never want.

We would, therefore, request you to replace these two adamant officials forthwith and to reconstitute the B.O.T. with sincere, honest and knowledgeable people to manage the Funds as per HSPF Rules.

Thanking You,

With thanks and best regards,
Yours faithfully,

Sub: Request for uniformity in policy regarding ‘Participation of Children and Grand Children’ of regular and ex-employees in SAIL’s programmes etc.

Dear Sir,

This has come to our information that during celebrations of specific programmes like SAIL Day, World Environment Day etc. organized officially by SAIL at Ranchi Children and Grand Children of Ex-Employees are not allowed to participate in the programmes. We feel that it looks like too narrow an attitude towards children who are residing in the same places and enjoying their life together with those of regular employees.

While celebrating their Silver Jubilee in 1987-88 MECON distributed Bata made school bags to the school going children of their employees. When the then Chairman Sri V. Krishnamurthy came to know of this he asked MECON Mgt. to distribute the same school bags on SAIL account to all the children irrespective of their parent’s profession and association.

I hope and request for the same kind of magnanimous attitude from present SAIL Mgt. while dealing with participation of children.

With thanks and best regards,
Yours faithfully,

(V.N.Sharma)
